Terms of Service

These Terms of Service ("Terms") govern your access to and use of BuyShipping (buyshipping.app), operated by DARGO TECH, INC ("we," "us," or "our"). By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, do not use BuyShipping.

1. Service Description

BuyShipping is a web application that enables e-commerce sellers to manage and purchase shipping labels across multiple marketplaces, including Amazon, Walmart, Wayfair, and Shopify, from a single dashboard. Our service connects to marketplace APIs on your behalf to retrieve orders and generate shipping labels.

2. Account Registration

To use BuyShipping, you must:

  • Provide accurate and complete registration information, including a valid email address.
  • Maintain the security of your account credentials. You are responsible for all activity under your account.
  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Notify us immediately if you suspect unauthorized access to your account.

3. Marketplace Accounts

By connecting your marketplace accounts (Amazon, Walmart, Wayfair, Shopify) to BuyShipping, you authorize us to access your marketplace data through their respective APIs solely for the purpose of retrieving orders and generating shipping labels. You represent that you have the authority to grant this access and that your use of BuyShipping complies with each marketplace's terms of service and seller agreements.

4. Plans and Pricing

BuyShipping offers the following plans:

  • Free Plan: Limited features at no cost, including 1 platform account, 1 warehouse, and 25 shipping labels per month (Amazon only).
  • Starter Plan: Expanded features with 5 accounts, 3 warehouses, 500 labels per month, and all marketplace platforms.
  • Pro Plan: Full features with 20 accounts, 10 warehouses, unlimited labels, Autopilot shipping, and priority support.

Pricing is displayed on our Pricing page and is subject to change with reasonable notice. Changes to pricing will not affect your current billing period.

5. Billing and Payment

  • Paid plans are billed monthly or annually, depending on your selection. Payment is processed through Stripe.
  • Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
  • You may cancel your subscription at any time from your account settings. Your paid features remain active until the end of the current billing period.
  • Refunds are not provided for partial billing periods. If you cancel mid-period, you retain access until the period ends.
  • If payment fails, we may suspend access to paid features until payment is resolved.

6. Free Trials

We may offer a free trial for paid plans. During the trial period, you have access to all features of the selected plan. No credit card is required to start a trial. If you do not subscribe before the trial ends, your account will revert to the Free plan.

7. Acceptable Use

You agree not to:

  • Use BuyShipping for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to access, tamper with, or use non-public areas of the service, our systems, or our providers' systems.
  • Reverse engineer, decompile, or disassemble the service or attempt to derive source code.
  • Use the service to send unsolicited communications or for purposes unrelated to e-commerce shipping.
  • Share your account credentials with third parties or allow unauthorized access to your account.
  • Interfere with or disrupt the service, servers, or networks connected to the service.
  • Automate access to the service beyond what is provided through our interface and APIs.

8. Shipping Labels and Carrier Services

BuyShipping facilitates the purchase of shipping labels through marketplace APIs and third-party carriers. We do not act as a carrier and are not responsible for the delivery of packages. Shipping costs are charged by the respective marketplace or carrier, not by BuyShipping (except for our subscription fee).

You are responsible for ensuring that package dimensions, weights, and shipping information are accurate. Incorrect information may result in additional charges from carriers or label voidance.

9. Data and Privacy

Your use of BuyShipping is also governed by our Privacy & Data Handling Policy, which describes how we collect, use, and protect your information. By using BuyShipping, you consent to the data practices described in that policy.

10. Intellectual Property

The BuyShipping service, including its design, features, code, and content, is owned by DARGO TECH, INC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the service.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to BuyShipping. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including marketplace API outages. We are not liable for any losses resulting from service downtime.

12. Limitation of Liability

To the maximum extent permitted by law, DARGO TECH, INC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of BuyShipping. Our total liability for any claim arising from the service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

BuyShipping is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or available at all times.

14. Indemnification

You agree to indemnify and hold harmless DARGO TECH, INC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of BuyShipping, your violation of these Terms, or your violation of any rights of a third party.

15. Account Termination

We may suspend or terminate your account if:

  • You violate these Terms or any applicable law.
  • Your marketplace account access is revoked or suspended by the marketplace.
  • We are required to do so by law or a marketplace partner.
  • Your account has been inactive for an extended period.

You may delete your account at any time from your account settings. Upon termination, your data will be handled in accordance with our Privacy & Data Handling Policy.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this page. Your continued use of BuyShipping after changes are posted constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of BuyShipping shall be resolved in the courts located in the State of Delaware.
